Injuries as a result of an auto accident have the potential to affect almost all of us, seeing as how the majority of Americans either are drivers or passengers in cars on a daily basis.

There are approximately 3 million whiplash injuries sustained in the U.S. every year. Many cases of whiplash are unreported or go untreated due to the seemingly minor low speed collision or minimal, or any, amount of damage to the involved vehicles. It is also estimated that 45% of people who suffer from chronic neck pain do so as a result of a previous whiplash injury.

Although whiplash is the most commonly thought of injury with auto accidents, it is very common for people to receive injuries to the hips, knees, shoulders, back, and ribs to name a few.


It is very common, especially with low speed collisions, for there to be no pain immediately after the accident. Often it takes several days or longer for any pain to appear. Most people believe that if they do not have pain immediately following the accident, or if it’s a week or two after the accident before they start having pain, then they can’t receive treatment for it, or have any treatment included in the insurance claim. This is completely false.
It is routine for auto accident patients to begin care weeks or months after the accident, despite what your insurance company may lead you to believe.

Well Managed Chiropractic Soft Tissue Injury

The "Well Managed Soft Tissue Injury Case" can be a bit misleading as it means different things to different people.

The insurance companies or "defense" side, seem to have one set of expectations from the medical and chiropractic communities, while those who treat these injuries have a different set of expectations from the insurance carriers.

There are those on the "defense" side who maintain all soft tissue injury patients should be released after several weeks of care and any patient who complains further has a financial motive.

The other extreme is typified by our personal experience with a case in which the doctor treated the patient 454 times for an uncomplicated soft tissue injury.

Neither point, in our opinion, is rational and both fail to represent a well managed soft tissue injury. The management of these patients should fall under the dual heading of "medical" and "legal" issues as both areas are critical to the case.

How long has it been since you were involved in an auto accident?

If so, did you get evaluated by a chiropractor?  If not, you should have.  It is never too late. 

My San Diego Chiropractic Office treats many individuals for neck pain, back pain and headaches that are related to auto accidents.  While many of our patients are treating for accidents that occurred recently, in many cases the auto accidents in question occurred years earlier and the initial symptoms were not taken seriously. 

I have always found it a bit odd that in general people don’t take the time to seek treatment for themselves yet they scramble to get their cars fixed. 

I don’t know why so many of us carry these kinds of thought processes.  In the case of auto accident injuries, the little bit of neck pain or the headaches or the low back pain is often overlooked or dismissed and minimized as being un-important.  This is flawed thinking.  Imagine if we treated other health conditions with such disregard. 

The injury mechanisms in whiplash type accidents are complex.  Muscles are stretched and torn, ligaments can sometimes partially tear or rupture, discs can become herniated and spinal fractures can occur.  These injuries can lead to a number of different symptoms that can cause neck pain or back pain that ranges in intensity from a slight irritation all the way to severe disability.  Back pain and neck pain are bad enough in the short term and much worse in a long-term chronic situation.

While the mechanism of injury in whiplash cases is complex, the typical resulting spinal injuries follow a well-established path.  Initially, the muscles and ligaments in the injured area are irritated.  This irritation leads to inflammation.  Inflammation is not only responsible for many of the initial symptoms that you experience but it is also responsible for scar tissue formation which can make your symptoms permanent or chronic.

Statistically, 25% of auto injury victims will continue to suffer from ongoing symptoms related to their accident.  I see this statistic play out in my San Diego chiropractic office on a regular basis. 

Chiropractors are experts in dealing with the types of neck pain, back pain and headaches that occur as a result of auto accidents.  The best way to insure that you are not a member of this group of 25% that never fully recover from their auto accident injuries is to get an examination and treatment as recommended by your chiropractor.

Safe Driving and Car Accidents In San Diego


Being a Chiropractor in San Diego, my office provides treatment for many whiplash accident victims.  One of the reasons for these accidents is wet weather driving.  Since we don’t have rain throughout the year in this desert community, when it does rain, oil and debris that has been sting on the road all year long loosens resulting in a very slick driving surface. 

Car accidents are serious!  You may not be aware that approximately 25% of all car accident victims never make a full recovery.  That could mean a lifetime of neck pain, low back pain, headaches, etc.

The best defense for accident prevention in wet weather is defensive driving.  The following paragraphs were found on the National Safety Council website and specifically target safe wet weather driving techniques.

“Losing control of your car on wet pavement is a frightening experience. You can prevent skids by driving slowly and carefully, especially on curves. Steer and brake with a light touch. When you need to stop or slow, do not brake hard or lock the wheels and risk a skid. Maintain mild pressure on the brake pedal.

If you do find yourself in a skid, remain calm, ease your foot off the gas, and carefully steer in the direction you want the front of the car to go. For cars without anti-lock brakes, avoid using your brakes. This procedure, known as "steering into the skid," will bring the back end of your car in line with the front. If your car has ABS, brake firmly as you steer into the skid.

While skids on wet pavement may be frightening, hydroplaning is completely nerve-wracking. Hydroplaning happens when the water in front of your tires builds up faster than your car's weight can push it out of the way. The water pressure causes your car to rise up and slide on a thin layer of water between your tires and the road. At this point, your car can be completely out of contact with the road, and you are in danger of skidding or drifting out of your lane, or even off the road.

To avoid hydroplaning, keep your tires properly inflated, maintain good tread on your tires and replace them when necessary, slow down when roads are wet, and stay away from puddles. Try to drive in the tire tracks left by the cars in front of you.

If you find yourself hydroplaning, do not brake or turn suddenly. This could throw your car into a skid. Ease your foot off the gas until the car slows and you can feel the road again. If you need to brake, do it gently with light pumping actions. If your car has anti-lock brakes, then brake normally; the car's computer will mimic a pumping action, when necessary.

A defensive driver adjusts his or her speed to the wet road conditions in time to avoid having to use any of these measures. Reprinted with permission from the National Safety Council”

If you do happen to get into a fender bender, get to the chiropractor ASAP.  From a statistical standpoint, the best way to avoid becoming one of the 25% of Car Accident  injury patients that never fully recover is to undergo an examination with a licensed chiropractor and follow up with any recommended treatment as soon as possible.

Managing Soft Tissue Injury with Chiropractic

Medical Management in Personal Injury cases

Our experience with these cases comes from clinical practice, file reviews, and contributions to the scientific literature on the subject. With this said, we are in a unique position to see cases at the request of both the plaintiff and defense.

Both sides utilize our opinion and both desires to know what, in our opinion, constitutes a well managed soft tissue case. Both sides, it seem, have a strong desire to be reasonable, but the different levels of expectations mentioned earlier make each party feel the other is often being unreasonable.

Legal Issues in a Personal Injury Suit


The plaintiff side of the issue is represented by the patient's attorney and we have discovered they are often placed in a position of "pressure" when attempting to justify some of the patient care issues common to the handling of soft tissue cases by the doctor or therapist.

We believe anything which allows the claim to pass through the "legal" process easier, will be greatly appreciated by the attorney and will often result in a better long-term working relationship with the attorney. This better relationship often results in greater utilization of the doctor's services by the attorney.

If, on the other hand, the clinical treatment of the doctor or therapist causes the case to lose value, the possibility of a long-term relationship decreases dramatically.

For example, the case we mentioned earlier in which the doctor treated the patient 454 times for an uncomplicated soft tissue injury, makes the case very difficult for the attorney to move the case through the "system" and do justice to their client's interests. This type of behavior makes the claim lose value and results in protracted litigation before settlement.

Whiplash Accidents

In my San Diego based Chiropractic Clinic we provide treatment for those patients involved in auto accidents on a regular basis.  The most common injury resulting from car accidents is whiplash.

Whiplash is most frequently associated with rear-end auto accidents in which the heads of those in the front car are suddenly snapped backward and forward by the acceleration caused by the impact.  The more descriptive medical phrase used to convey this type of injury is cervical acceleration/deceleration (CAD) trauma or syndrome.  CAD accurately describes the rapid movements that can injure the vertebrae of the neck and the muscles and ligaments that support them.

Anyone can be subjected to whiplash at almost any speed, even in a minimal-force auto accident at speeds as low as 5mph.   Incidents that cause whiplash can also be related to other incidents or mishaps in which the head is pushed or jerked beyond its normal range of motion.  Whiplash commonly causes serious and chronic neck pain, as well as back pain, headaches blurred vision, ringing in the ears, nausea, numbness and dizziness. More serious injuries such as bruising of the brain can sometimes occur in auto accidents.

The sudden accident that caused the initial whiplash injury may fade into memory, but the physical and psychological damage of whiplash can become chronic, severely eroding the victim's quality of life.

Chiropractic techniques are particularly well-suited to relieving the neck pain and other debilitating effects of whiplash because they can
• restore movement lost after the accident,
• overcome muscle weakness and enhance muscle tone,
• speed recovery, and
• diminish chronic symptoms that can persist or recur over many years.

Statistics indicates that every seven years you will be involved in an automobile accident.  Before you panic you should know that in my San Diego based Chiropractic Clinic we provide treatment for those patients involved in auto accidents on a regular basis.  I have treated patients in their 60’s, 70’s and 80’s who have never been in a car accident and I have treated people who are in their 20’s and 30’s who have been in half a dozen.  Some people just have enough accidents to cover all of us! 
The most common injury resulting from car accidents is whiplash.  Whiplash is a medical term that describes an injury that involves straining, spraining and sometimes tearing of the muscles and ligaments that move and support our joints, especially the joints of our spines.
Whiplash is most often associated with rear-end type auto accidents in which the heads and necks of those in the car being hit are suddenly snapped violently backward and forward by the force of the impact. 
Whiplash can occur at almost any speed, even in low force auto accident at speeds as low or less than 5mph.   Whiplash can also be related to other incidents or mishaps in which the head is pushed or jerked beyond its normal range of motion. 
Common outcomes of auto accident injuries include serious and chronic neck pain, as well as back pain, headaches, blurred vision, ringing in the ears, nausea, numbness and dizziness. More serious injuries such as bruising of the brain can sometimes occur in auto accidents resulting in concussion.

Back pain, neck pain and headaches are typical symptoms that people experience after a car accident.  When we are involved in car accidents muscles get strained, ligaments get sprained and inflammation starts to settle in around the injured joints. 

As it turns out, inflammation plays a big role in our health following a motor vehicle accident.  Inflammation causes the muscles to tighten or spasm in an effort to protect the joint.  Inflammation also causes us to feel pain.  If the inflammation lasts for more than a few days it will cause scar tissue to form around the joints which also causes pain and decreased range of motion.

Since chiropractic care is so effective in treating the injuries associated with car accidents, I see many of these patients in my San Diego Chiropractic Center.  Many of these patients had never been to a chiropractor prior to the care that they will receive because of their accident. 

Chiropractic care for auto injuries should involve three separate phases of care. 

The first phase of care should be directed toward to relieving pain.  Ice packs, electrical stimulation, ultrasound and spinal manipulations all help to reduce pain and tension.

The second phase of care is directed toward improving the range of motion of the injured joints.  It is important to “remodel” as much as the scar tissue as possible to help you maintain your full range of motion in the future.

The third phase of care is directed towards building strength and flexibility in and around the injured joints. Strong, flexible muscles that work to move joints that have full range of motion will help you maintain your spinal health in the future.

Neck Pain from Whiplash-Car Accident Injury

Whiplash is an injury typically seen when you get rear-ended in an auto accident. Rear end car accidents only make up about 25% of all car crashes, yet they account for about 40% of all car crash injuries.  Research has shown that subjects can have whiplash injuries in rear end collisions of less than 5 mph, probably slower than you drive in a parking lot. 

This is one reason why whiplash injuries make up such a large percentage of auto accident injuries.  Almost half of Americans who suffer from chronic neck pain, attribute it to a previous whiplash injury.

Whiplash pain
usually involves some or all of these symptoms, reduced neck range of motion, neck pain, muscle pain, or headaches.  If you experience any of the symptoms after a car accident then you should see an auto injury specialist immediately.

It is common for whiplash pain to not show up until weeks or months after the accident.  Most of these people are the ones who never get help for their pain, and are at much greater risk for developing chronic neck pain in the future.

Pain from Car Accidents

Whiplash Season Is Coming

During this time of year, we start getting calls from both established and new patients regarding aches and pains related to auto accidents.  During a rainy commute, the number of auto accidents can be 4 to 5 times the number that occurs on dry roads.  My Chiropractic office in San Diego has seen hundreds of auto accident / personal injury victims over the last 15 years.
 
The most common injury resulting from auto accidents is the classic neck injury termed whiplash.

Whiplash is a traumatic neck injury that results from a sudden, forceful backward / forward snapping movement of the head.  The head is heavy compared to the size of the muscles that help turn and tilt your head.  Because of the violent acceleration and deceleration of the head, the soft tissues of the neck are overwhelmed with the stresses of the gravitational forces.  Ligament damage, pinched nerves, muscle tearing, spasm and spinal misalignment are typical results of whiplash.

Whiplash can become a nagging, intolerable condition if left untreated.  Many people make the mistake of judging the amount of injury to their body’s based on the force of impact or the amount of damage to the car.  This is poor judgment.  There are many factors that determine how a person is rear-ended by a second vehicle traveling 60 mph walks away unhurt while an apparently light tap on the bumper in a parking lot can cause enough pain to ruin your summer.   Factors including the angle of the impact, speed of the impact, occupant awareness of the impending impact, head tilt or rotation, use of seatbelts and area of impact all play a role in why some people are injured in accidents and some are not.  

Many people do believe that only high speed impacts can cause injury, however even a low-speed impact in an auto accident can cause serious whiplash injuries.  Whiplash symptoms can occur instantly but typically take days, weeks, or even months to develop.

Neck pain is by far the most common whiplash symptom, along with headaches, muscle spasms, shoulder pain, dizziness, ringing in the ears (tinnitus), arm pain and tingling, and insomnia.  The constant presence of symptoms can make whiplash a debilitating problem, even resulting in clinical depression.

A common problem associated with whiplash is the misalignment of the vertebrae in the neck.  If left untreated, these vertebrae will remain misaligned, causing chronic neck problems in the future, including loss of range of motion, chronic headaches and arthritis.

A 1998 Canadian study on whiplash examined more than 10,000 cases of neck injuries and concluded that chiropractic adjustments are one of the only proven treatments for whiplash injuries. This study also concluded that “accepted’ treatments such as neck collars, muscle relaxers, immobilization, and rest were not helpful for whiplash victims.

Orthopedic Supports for Soft Tissue Injuries

Orthopedic Supports

 The use of orthopedic supports, such as a cervical collar, during the acute states of the injury, is a common clinical practice in both the medical and chiropractic communities.It is, however, a double-edged sword.

The most reasonable approach would entail use of these supports during the functional instability phase of injury, followed by removal as prolonged use can lead to dependency.

Typically, the support is most beneficial during the ten days following the trauma. Prolonged use would support the need for additional investigation, which must include consideration of a psychological component.

X-rays

The initial use of x-rays in the well managed soft tissue injury is well supported in the scientific literature. The use of "follow-up" series of x-rays is, however, debated. We have found the use of serial x-ray studies is usually unwarranted, absent the clinical management of clear osseous injuries or delayed instability. The prudent use of x-rays should always consider the potential harm from radiation exposure. This is especially true in patients of child bearing years.

The use of repeat plain film radiographs will often bring the case under immediate scrutiny, thus, complicating the settlement process.

Addressing soft tissue personal injury case

This discussion is designed to address the soft tissue

personal injury case and to offer what we consider are reasonable points of view which are supportable in the literature when possible.

In our experience, failure to follow a reasonable approach often leads to close scrutiny of the claim. It is our hope this discussion will bring the two different levels of expectation a bit closer and result in a higher level of cooperation between the two sides.

Additionally, if the case you manage as the treating practitioner can pass through the medical/legal system, your relationship with the plaintiff attorney can only flourish. However, if the attorney representing the patient loses a potential award as a result of many of the topics mentioned in this article, how likely could an expanding relationship be?

Scope of Care

Obviously, the correct diagnosis is paramount in treating any patient following trauma. We will assume, for the purposes of this discussion, the case being treated represents an uncomplicated soft tissue injury. Specifically, injuries that are absent fractures neurological deficits, dislocations, disc herniations or vascular complications.

Treatment rendered for these injuries should represent the standard of care for the geographic area serviced.

The "scope of practice" or treatment rendered should be designed to make passage through the medical/legal system easier.

For example, performing reflexology on a patient's feet for cervical spine injuries will draw more attention than the well accepted treatment course of manipulation, moist heat, ice, ultrasound, and other therapies.

This is not to say that payment will be denied, but the road to reimbursement and settlement would be much easier if a more traditional approach to care is rendered.

Treatment Times for a Soft Tissue Injury

Duration of Care

The scientific literature indicates the vast majority of healing will take place during the first three weeks following the traumatic event. In addition, the majority of the injuries seen are limited to muscular injuries and treatment of patients over 90 days, in our experience, often hinders the solving of the legal matters.

This is not to say that all soft tissue injuries need 90 days of care. Care, like the patient's injuries, are individual. But, if treatment is longer than 90 days, it should be stressed that the clinical necessity for care should be justified even more.

It is the doctors responsibility to prove the care is needed, not the insurance company's responsibility to prove it's not needed.

In our experience and opinion, documenting only the patient's subjective complaints, is insufficient criteria for the continuation of care.

To support the need for continued care, the documentation within the file should show timely re-examinations which demonstrate objective physical examination findings.

In addition, these objective signs would need to be reasonably "weighed" against the clinical potential for further healing.

It is reasonable to assume the injured tissues will necessitate a higher frequency of care during the initial stages of injury. This is due to the fact that the patient's subjective complaints are often at or near their zenith during the first week after the accident.

The injured tissues swell to their greatest degree during this time; thus, the level of the patient's complaints. As the injuries enter the subacute and chronic stages, it is reasonable to assume the treatment frequency would decrease and correlate with the clinical gains being made.

Since the goal of all treatment is to return the patient to their preinjury status, a well managed case will include decreased treatment frequency while occupational and daily activities are slowly reintroduced.

In our experience, we have found a constant treatment frequency maintained from the onset of care can lead to problems for the plaintiff attorney as they have to explain this apparent inconsistency.

Consider how they will attempt to explain the following questions: First, how can an accurate prognosis of the patient's future medical/chiropractic condition be measured if the treatment has remained the same?

Secondly, how could the patient reach their preinjury status if the normal occupational and daily stressors were not introduced while under treatment? An unreasonable approach to treatment frequency complicates settlement.
